These Terms of Service (“Terms”) govern your access to and use of FairlyHire, operated by Casimir Technologies LLC (“FairlyHire,” “we,” “us”). They apply to interviewers and organizations that use the service (“you”). By creating an account or using the service, you agree to these Terms.
Private beta. FairlyHire is currently provided free of charge as a private beta. It is offered “as is,” may change or be interrupted, and carries no service-level or uptime guarantee.
1. The service
FairlyHire is a consent-based interview-integrity tool. A candidate runs our agent, which looks for known cheating tools and windows hidden from screen capture, and reports a verdict and findings to the interviewer who created the session. What the agent does and does not collect is described in our Privacy Policy.
2. Your responsibilities
You are responsible for using FairlyHire lawfully and fairly. In particular, you agree to:
- Obtain candidate consent and give notice. Only use FairlyHire with candidates who have been informed and have consented, as the product is designed to require. You are responsible for complying with all applicable employment, privacy, and monitoring laws in your and your candidates’ jurisdictions.
- Use verdicts responsibly. A FairlyHire verdict is an integrity signal, not a determination of guilt and not a hiring decision. You are solely responsible for your hiring decisions and must not treat a verdict as the sole basis for an adverse decision about a candidate.
- Keep your account secure and not share access credentials. You are responsible for activity under your account.
- Not misuse the service — including no attempts to disrupt, reverse-engineer, circumvent security, or use it to surveil people outside a consented interview context.
3. Accuracy and no warranty
Cheating-detection is inherently imperfect. FairlyHire may produce false positives or false negatives. The service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the fullest extent permitted by law.
4. Intellectual property
FairlyHire, including its software, agent, and content, is owned by Casimir Technologies LLC and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the service per these Terms. You retain rights to the data in your account; you grant us the rights needed to operate the service for you.
5. Limitation of liability
To the fullest extent permitted by law, Casimir Technologies LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service. Because the service is currently free, our total aggregate liability will not exceed one hundred U.S. dollars (US$100).
6. Indemnification
You agree to indemnify and hold harmless Casimir Technologies LLC from claims arising out of your use of the service, your hiring decisions, or your failure to obtain candidate consent or comply with applicable law.
7. Suspension and termination
You may stop using the service at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the service. We may modify or discontinue the beta at any time.
8. Changes to these Terms
We may update these Terms; we will revise the “last updated” date and, for material changes, take reasonable steps to notify account holders. Continued use after changes means you accept them.
9. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to its conflict-of-laws rules, and the exclusive venue for disputes will be the courts located there.
